These following terms of use constitute a legally binding agreement (the “Agreement”) between you (hereinafter  referred to as “you”, “yours”, “user” or “visitor”) and Curemigraine.org, a website with Url https://curemigraine.org/ (the “Site”) registered under the laws Norway (hereinafter referred to as “we” “our” or “us” or “Curemigraine.org”) and any services you use, receive or access from or through our Website or Platform or otherwise through arrangements made by our customer care service or operational staff.

PLEASE READ THESE TERMS OF USE WITH DUE CARE AND CAUTION AND UNDERSTAND THEM BEFORE ENTERING INTO THIS AGREEMENT AND/OR USING OUR SERVICES THROUGH THE WEBSITE AS IT CREATES A CONTRACTUAL RELATION BETWEEN THE SITE AND YOU AND SET CERTAIN RESTRICTIONS AND LIABILITIES UPON BOTH OF THE PARTIES. BY ACCEPTANCE OF THESE TERMS OF USE OR INDICATION OF ACCEPTANCE OF THESE TERMS, YOU EXPRESSLY ADMIT AND CONSENT THAT YOU UNDERSTAND THIS AGREEMENT AND ACCEPT ALL OF ITS TERMS AS IT IS. YOU ADMIT THAT YOU WILL NOT USE THIS PLATFORM FOR ANY PURPOSE THAT IS DECLARED ILLEGAL OR UNLAWFUL BY THIS AGREEMENT. IF YOU VIOLATE OR BREACH ANY TERM OF THIS AGREEMENT, IT MAY RESULT IN CERTAIN LIMITATION, RESTRICTIONS OR REPERCUSSIONS FOR THE YOU, INCLUDING SUSPENSION OF THE USER ACCOUNT, ETC. IF YOU DO NOT AGREE WITH THESE TERMS, YOU MUST IMMEDIATELY STOP USING THE SITE OR USING ANY SERVICES ACCESSED THROUGH THE PLATFORM. WE ARE AUTHORIZED TO MAKE CHANGES OR AMENDMENTS IN THESE TERMS FROM TIME TO TIME FOR ANY REASON WITH A PRIOR NOTICE.

SERVICES

The Curemigraine.org website (the “Website”) is an online platform that offers a 90-day personalized program called The Scandinavian Method to help reduce migraines and tension-type headaches (the “Services”). The Scandinavian Method is the name of the program and does not imply an officially recognized or evidence-based treatment endorsed by Scandinavian medical authorities. The program includes postural therapy with corrective exercises, guidance on healthy living with a focus on nutrition and daily exercise, and stress relief techniques. Its purpose is to improve overall health, posture, stress levels, and sleep while reducing headache frequency and intensity.

ACCOUNT REGISTRATION

For the purpose of visiting, using, accessing or availing of the services provided by Curemigraine.org, each user/visitor (hereinafter “USERS”) shall create an account by providing personal information including but not limited to full name, a valid email address or and unique password as required by the site. By creating an account (“Account”) you expressly declare that you have read, understood and accepted these Terms of Use and you will also comply with the following;

  1. You will provide complete, true and accurate personal information as required while creating an account,
  2. You must be at least 18 years of age, if you are less than 18 years then you are not allowed to use our site,
  3. You will not provide misleading, inaccurate, incomplete, incorrect or prohibited information,
  4. You agree to receive certain of the services provided to you through this platform via any third-party service providers being controlled or supervised by Curemigraine.org,
  5. You will protect your account’s unique password, and we advise you to not share any confidential information with anyone else. You are the sole owner of your account.
  6. You will bind the legal entity to whom you represent.

The Curemigraine.org contains information, communications, forms, software, images, sounds, materials, music, graphics, photos, videos and other material and services (the “Curemigraine.org’s content”). The Curemigraine.org tries to provide content that is true and accurate, but does not warrant the accuracy, timeliness or applicability of any of the content. The curemigraine.org reserves the right to change and modify the content at any time. Nothing in the content can or should be considered the basis of a contract between you and the curemigraine.org. The content is also generated based on the responses you provide in our initial questionnaire. However, we do not manually review or verify this information. While our guidance and recommendations are according to your inputs but they do not constitute a fully customized or individualized treatment plan. The content, including information provided about health care, is for informational purposes only. Please note that medical information in particular changes rapidly, and some of the content may contain inaccuracies or typographical errors. Curemigraine.org does not promise or give warranty of any kind, either expressed or implied, regarding the quality, accuracy or validity of the content except where specifically stated.

USER CONTENT

By submitting, uploading, sharing, streaming, storing, or otherwise providing any text, images, audio, video, data, or other materials (“User Content“) on or through CureMigraine.org, you hereby grant CureMigraine.org a non-exclusive, worldwide, irrevocable, transferable, sub-licensable, and royalty-free license to use, copy, reproduce, distribute, process, adapt, modify, translate, publicly perform, display, publish, and otherwise exploit such User Content, in whole or in part, in any media format, for the purpose of operating, improving, marketing, and providing the services offered by CureMigraine.org. This includes, without limitation, the right to publicly associate and display your username in connection with such User Content.

Notwithstanding the foregoing, CureMigraine.org does not claim any ownership rights over your User Content. Subject only to the limited rights granted to CureMigraine.org under these Terms, you retain all rights, title, and interest in and to your User Content. However, you acknowledge and agree that once your User Content is submitted, it may be accessed, used, or shared by other users, and CureMigraine.org shall not be liable for any use, reproduction, modification, or distribution of your User Content by third parties.

You further represent and warrant that:

  1. You are the sole owner of, or have obtained all necessary rights, licenses, consents, and permissions to grant CureMigraine.org the rights specified herein;
  2. Your User Content does not infringe upon, misappropriate, or violate any intellectual property rights, privacy rights, or other legal rights of any third party;
  3. Your User Content does not contain any unlawful, defamatory, obscene, threatening, or otherwise objectionable material;
  4. You assume full responsibility for any liability arising from the submission, publication, or dissemination of your User Content on CureMigraine.org.

CureMigraine.org reserves the right, but is not obligated, to review, remove, or restrict access to any User Content at its sole discretion if it determines that such content violates these Terms, applicable laws, or third-party rights. Users acknowledge and agree that CureMigraine.org shall not be responsible or liable for any loss or damage arising from the use of, or reliance upon, any User Content available through the platform.

Commencement AND TERMINATION

Unless terminated earlier by either party, this Agreement will commence and become effective immediately upon your creation of a Curemigraine.org’s account or availing of our services directly through our platform.

Either party may terminate this agreement upon seven (7) days prior written notice to the other party upon the other party’s material breach of this agreement.

In addition, Curemigraine.org may, at any time, terminate this Agreement immediately in the event that:

  1. you no longer qualify to accept services under applicable law, rule, permit, ordinance or regulation;
  2. your violation or breach of any representation, warranty, covenant contained in the terms of this agreement; and
  3. For any reason essential to protect the safety of the website community or third party’s rights.

Restrictions

We may at any time restrict, limit, suspend or terminate the services provided by this site (whether paid or unpaid) or delete user’s account if we suspect, find or believe in an investigation that;

  1. you are not up to the legal age of 18 years or otherwise not having the capacity to enter into this agreement,
  2. Your website account is being used by any other person,
  3. If you intentionally violate or breach any term of this website or attempt to violate the same,
  4. You are involved in activity harmful or threatening to the platform,
  5. If you deliberately and without any sufficient reason damage the reputation or goodwill of the platform or attempt to damage the reputation or goodwill of this platform,
  6. If you defame or use abusive language to our agents, employees and customers.
  7. You are spreading defamatory or libelous material by using this site.
  8. Any action which is deemed essential for the protection or safety of our community or third party’s rights.

You agree that you are the sole owner and protector of your account and we advise you not to allow any other person to use your user account.

USER’S RESPONSIBILITIES AND OBLIGATIONS

While using this Curemigraine.org, you consent to comply with the following acceptable term of use and submit that;

  • You will provide true, accurate, complete and updated personal information like name, age and email address while registering on this site and refrain from submitting fake, misleading, untrue and/or inaccurate information,
  • You will not resale or share your personal org’s account with others,
  • You will not become a part or in any way promote any kind of illegal activity including by way of hacking, drug taking, self-harm, human trafficking, terrorism, cracking or distribution of counterfeit software while using org,
  • You are not allowed to contact the users or visitors privately with offers or suggestions or behave abusively,
  • Your content must not be hateful, abusive, racist, discriminatory, sexually offensive, obscene, vulgar, defamatory, threatening to another user, promotes violence or hatred against a person or group of people,
  • You will not infringe third-party rights such as copyright, trademark, trade secret or any other personal or proprietary rights;
  • You will not personify yourself as another person to infringe the identity of other people;

We reserve the right to cancel, suspend or restrict user access to the site or terminate the account without warning if we find that the user is deliberately violating these terms.

BLOCKING OF IP ADDRESSES

You agree that in order to protect or secure the integrity or goodwill of the website, Curemigraine.org may at any time block users or subscribers from certain IP addresses or computers from accessing the Site.

Any notices or other communications permitted or required hereunder will be in writing and given by Curemigraine.org;

  • by post to your residential address.

For notices made by e-mail, the date on which such notice is transmitted will be deemed the date of receipt.

You acknowledge and agree that we shall not be held liable or responsible for any third-party link or its content including accuracy, offensiveness, contents, opinions, reliability, or policies contained therein. We advise and suggest you read their policies first before using or availing of services as we do not endorse their content.

INTELLECTUAL PROPERTY RIGHTS

You admit that the trademarks, logos, service marks, and service names available on the Curemigraine.org are the intellectual property rights of the website. You are strictly prohibited to use without prior authorization of the Curemigraine.org any Intellectual Property, including but not limited to patents, trademarks, designs and copyright of the Curemigraine.org. If we suspect any violation or infringement of intellectual property rights of the site or anyone else by any user, we may in our sole discretion remove or disable the user’s account.

DISCLAIMERS AND LIMITATION OF LIABILITY

All content or services on this site are provided on an “AS IT IS” and “AS AVAILABLE” basis, without any assurance or warranty of any kind, either express or implied, with respect to quality, fitness, merchantability, completeness, reliability for a particular purpose, non-infringement, compatibility, security, accuracy, indirect or consequential loss or corruption of your data, and those arising by statute or otherwise in Norway law.

Curemigraine.org and its affiliates do not undertake responsibility of the uninterrupted and error-free functioning of the site or the content available will be free of harmful or destructive components or viruses. Your usage of the website or availing of any services provided by this Site is at your own risk and assumes the entire cost of all necessary servicing and repair or correction of your system.

Curemigraine.org or its affiliates, associates, directors or agents involved in the creation of the site or any content, will have no liability, contingent or otherwise, for any indirect, special, incidental, consequential, punitive, statutory or exemplary damages arising out of or relating to this agreement, warranty or tort (including negligence) or any other theory of liability or which arises out of or is in any way connected with (i) any usage of this site or content available on the site, (ii) any failure, interruption, delay or inability to use any portion of this site ), or (iii) the performance or non-performance by site or any third-party service providers or distributors, or ( iv) any claim arising due to any damage or viruses that may infect your computer equipment or other property on account of your access to, use of, or browsing in this site and (v) claim arising due to defamatory, offensive, or illegal conduct of other users or third parties.

If, notwithstanding the foregoing, we, our affiliates or any third party service provider or distributor are found liable for any loss or damage, the liability of Curemigraine.org and the third party providers and distributors shall be limited to the termination of the agreement and shall in no event exceed $100.

INDEMNIFICATION

  • any other illegal, unlawful or restricted activity in connection with the Services.

MODIFICATION TO THE AGREEMENT

You agree and admit that Curemigraine.org holds the discretionary right to make changes, alterations, amendments or modifications whether temporarily or permanently relating to (i) the whole or any of the terms/ provisions of this agreement, (ii) any features, functions or benefits or (iii) any policies related to the platform or (iv) the fees and costs relating to our paid services and (e) any others services provided by this platform at any time with or without prior notice, and such amended agreement shall be binding on you upon your acceptance of the revised agreement. You will be deemed to have been made aware of updates or modifications by your continued use of the site or platform. In case of material changes in terms, we will notify you via email or website notification. You are advised to regularly review our website for any updates relating to this agreement. Revised terms and conditions will become operative from the date of posting on the website. CureMigraine.org does not undertake any obligation to verify, monitor, or review Users acknowledge that they rely on such opinions, statements, or reviews at their own risk. While CureMigraine.org reserves the right, in its sole discretion, to remove or modify any such Content it deems inappropriate, offensive, misleading, or in violation of applicable laws. Users remain solely responsible for the accuracy, legality, and consequences of the content they post or share on the Platform.

GOVERNING LAW AND JURISDICTION

This Agreement is to be governed and interpreted in accordance with the laws of the Norway without regard to its conflicts of laws. Parties agrees that all disputes or claims arising out of or in connection with this agreement shall be resolved or settled by the federal courts of Norway having exclusive jurisdiction. In any action or proceeding, the prevailing party enforcing the terms of this Agreement shall be entitled to an award of its reasonable attorneys’ fees and costs.

GENERAL TERMS

  1. ENTIRE AGREEMENT These terms of use constitute the entire agreement between org and you and expressly replace, override and terminate all prior agreements and understandings whether written or oral, express or implied, relating to the subject matter governing their relationship.
  2. HEADINGS Headings of paragraphs used in this agreement are only for convenience and are not intended to limit or define the scope or interpretation of this Agreement.
  3. SEVERABILITY If any portion, or provision of this Agreement is declared to be invalid, unlawful, unenforceable, or in conflict with any law of a federal, state, or local government having jurisdiction over this agreement, the remaining provision shall continue to be valid and enforceable.
  4. FORCE MAJEURE org shall not be held responsible for any delay or failure to perform all or any part of its obligations under this Agreement if such failure or delay is directly or indirectly caused by the factors reasonably beyond the control of Curemigraine.org, including, without limitation such as acts of God, fog, embargo, fire, flood, storms, earthquake, the act of a public enemy, pandemic, strike or other labor dispute, acts of terrorism, government requirement, or civil or military authority.
